1. Acceptance of Terms

By downloading, installing, or using Noisy Mind ("the App"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the App. Noisy Mind is developed and operated by MeltinBit.

2. Description of Service

Noisy Mind is an iOS application that lets you record voice notes, have them transcribed directly on your device, and organize them into groups, tags, and merged notes. Transcription runs on your iPhone using a speech recognition model that the App downloads once, on first launch. On iPhones that support Apple Intelligence, the App can also generate titles and tidy up text using Apple's on-device model.

3. No Account Required

Noisy Mind does not require an account or sign-in. Your notes are stored on your device and, if you enable iCloud sync, in your private iCloud account managed by Apple. You are responsible for your device and Apple account security, and for keeping backups of notes you want to preserve.

You must be at least 13 years old to use the App.

4. Free Notes and Lifetime Purchase

Noisy Mind can be downloaded for free and includes a 30-day free trial with all features. After the trial, the App keeps working, including text notes and access to all your existing notes; recording new voice notes requires a one-time in-app purchase ("Lifetime Unlock"). There is no subscription and no recurring charge.

The Lifetime Unlock is tied to your Apple ID and can be restored on your devices at any time with the "Restore Purchase" button. Purchases are non-refundable, except as required by applicable law or Apple's refund policies; if a purchase is refunded by Apple, the unlock is removed.

All billing and payment processing is handled exclusively by Apple. MeltinBit does not collect or store any payment information.

5. Acceptable Use

You agree to use Noisy Mind only for lawful purposes and in a manner consistent with these Terms. You must not:

• Use the App to record, transcribe, or process content that is illegal, harmful, defamatory, or that violates the rights of others
• Attempt to reverse engineer, decompile, or modify the App or its underlying systems
• Use automated means to access or interact with the App
• Attempt to circumvent the free trial or the in-app purchase, or exploit any vulnerability in the App

6. Automatic Transcription

Transcriptions, titles, and text cleanup are generated automatically on your device and may not always be accurate or complete: names, numbers, and dates in particular may be transcribed incorrectly. You are solely responsible for reviewing and editing the content produced by the App before relying on it. MeltinBit does not guarantee the accuracy or quality of transcriptions.

7. Audio Recordings and Privacy

Your voice recordings and notes are processed and stored on your device and are never sent to our servers. For details on the limited data that leaves your device (the one-time model download and anonymous usage statistics), see our Privacy Policy.

You are responsible for ensuring that any recordings you make comply with applicable laws, including any consent requirements for recording conversations with third parties.

8. Intellectual Property

All content, design, code, and trademarks associated with Noisy Mind are the property of MeltinBit or its licensors. The App is licensed to you, not sold. You may not reproduce, distribute, or create derivative works based on the App or its content without our written permission.

You retain all rights to the content you create using the App, including your original voice recordings and the resulting transcribed text.

9. Availability and Updates

We strive to keep Noisy Mind available and functioning, but we do not guarantee uninterrupted or error-free service. We may update, modify, suspend, or discontinue the App or any of its features at any time, with or without notice.

In the event that the App is discontinued, we will make reasonable efforts to notify users in advance.

10. Limitation of Liability

The App is provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by applicable law, MeltinBit is not liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of data or inaccurate transcriptions.

Our total liability to you for any claim arising from the use of the App shall not exceed the amount you paid for the Lifetime Unlock.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ferrara, Italy.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised version with an updated date. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
